The rules for using this website and the portal.

1. Who we are and what these terms cover

This website is operated by Miescher OPS GmbH, operating as Scale With Fulfillment, a Swiss limited liability company, details in the legal notice. By using the website or the portal you accept these terms. If you do not accept them, do not use them.

2. Information, not advice

The playbooks, comparisons, benchmark pages, glossary and calculators are published to help coaching businesses understand the delivery side of their business. They are general information based on our experience and on third-party sources we cite. They are not legal, tax, accounting or investment advice, and they do not take your circumstances into account. Decisions you make from them are yours. Where a page touches law or tax, for example refund rules or earnings-claim regulations, check with a qualified professional in your jurisdiction before acting.

Third-party figures are quoted with their source and our assessment of the source's credibility. We do not guarantee that they are accurate or current. The calculators use simplified models that are explained on each calculator page; their outputs are estimates.

3. Results and testimonials

The results, numbers and quotes on this site come from named client engagements, published with the client's written permission, as described in the results and testimonials disclosure. They show what happened in those engagements. They are not typical, not a promise, and not a forecast of what will happen in your business, which depends on your program, your pricing, your team and where your retention starts.

4. Booking a call

The free audit is booked through Calendly: a short qualification form, then a calendar slot of 45 minutes. Submitting the form or booking a slot does not create a contract for services, and either side may cancel the call. The audit is a conversation about your delivery. Any engagement that follows is set out in a separate written agreement that states the scope, the fees and the term. We may decline to work with a business at our discretion, including where it does not meet the minimum size stated on the site.

5. Intellectual property

The text, visuals, drawn charts, calculators, code and design of this site, and the Performance-Based Fulfillment method and name, belong to Miescher OPS GmbH, operating as Scale With Fulfillment. You may read the content, link to any page, and quote short passages with attribution and a link. You may not reproduce whole pages or substantial parts of them, scrape or bulk-download the content, remove attributions, or use the content to train a commercial product without our written consent. Client names, logos and photographs are used with permission and may not be reused by you.

Automated access for search indexing and for AI assistants answering user queries is permitted in line with our robots file. Automated access that degrades the service or circumvents access controls is not.

6. The client portal

The portal at portal.scalewithfulfillment.com is available to clients under an engagement agreement and to our team. Accounts are created by us and are personal to the named user. You are responsible for keeping your login confidential and for what happens under it; tell us at once if you believe it has been compromised. You may upload only material you have the right to share, and nothing unlawful, infringing or harmful. We may suspend an account that breaches these terms or the engagement agreement, and we will remove access when an engagement ends, subject to the data retention described in the privacy policy.

We aim to keep the portal available and secure, and we back up its data, but we do not promise uninterrupted availability. Planned maintenance is announced where practical.

7. Acceptable use

Do not use the website or the portal to break the law, to send spam, to probe or attack our systems, to impersonate anyone, or to interfere with other users. Do not attempt to access data that is not yours.

8. Third-party services and links

The booking form, video players, communication channels and file sharing are provided by third parties named in the privacy policy, under their own terms. Links to other websites are provided for reference; we are not responsible for their content.

9. Liability

To the extent the law allows, we exclude liability for loss or damage arising from use of the website, its content or the calculators, including loss of revenue, profit or data. Nothing in these terms excludes liability for intent, gross negligence, or where liability cannot be excluded under applicable law. Liability under a client engagement is governed by that agreement.

10. Privacy

How we handle personal data is set out in the privacy policy, which forms part of these terms.

11. Changes

We may update these terms. The date at the top shows the current version. Continued use of the site after a change means you accept the updated terms. Material changes affecting portal clients are announced in the portal.

12. Governing law and jurisdiction

Swiss law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The courts at the registered office of Miescher OPS GmbH, operating as Scale With Fulfillment in the Canton of Lucerne have exclusive jurisdiction, subject to any mandatory rules that give a consumer the right to a different forum.
